Hey I had a question as to why this happens:

I got pulled over on the way home from a bike night down here about a month ago. Didn't get in trouble or a ticket or anything, but before I was allowed to leave, the officer took out this card thing and had me relay a bunch of info including my SSN, address, phone number, etc etc. SHe just said it was 'to keep record of being pulled over and why' and that it wasn't a negative thing. She didn't give me a good explanation as to why she needed the ton of info she did. I also don't see how this wouldn't reflect negativly on my record, if they keep track of it. Anyways, any light to be shed on this? I don't know if this is just a Eugene thing or what... :idunno:

I usually only ask for SSN if trying to confirm a warrant or I think someone is lying to me about their name. Never on a regular traffic stop though. Do they all do it down there or just this one guy???

Mine was a lady cop, so I don't know. She was nice, and I was nice, I didn't think it felt like she thought I was a shifty character. I kinda wanted to tell her no, but I figured getting a ticket wasn't worth it. I don't remember what else she asked for, but a bunch of info that wasn't on my ODL and didn't seem pertinent to the situation.

Seems strange to me. However I'm not a mind reader and dont know what she was thinking. Next time I would ask why they need that before giving it out. See what they say. Sorry I'm not much help to ya

I just found a site by: AMA.. You have to have mirrors and blinkers. Mirrors: you only need one to be legal in Oregon and two in Washington. Blinker You have to have them it they are originally equiped..

If your motorcycle doesn't have signals, then you can use hand signals; however, you are limited to only riding in the daylight. To ride at night, you are required to have signals.

As for the state of Washington...

but in WA you need two mirrors that can give you a clear view of at least 100ft behind you.

The mirrors on my FZ give me a clear view of my elbows 2 feet behind the mirrors. And they're stock!!!

I'm pretty sure I know the answer. I have to admit it's fun to watch Wa Co deputies face when I hand them two ID's when they ask for my license. Give one and get a cite, give two and get a warning. Most never ask for ins or reg after they see ID #2.

You give them both as a formality. Its not required, but if they ask, "do you have a gun on you." And you say "yes," the situation can get a little tense.:(

OK so an excoworker of mine said that she used to work at an insurance company and she found out there that if you get a ticket just pay one dollar more than the ticket and they will have to send you an over payment check. If you never cash that check than your ticket will never go on your record. This sounds to easy and I am sure the state is not that stupid, but then again...

So is this true or is this lady just as stupid as she looks?

The closest thing that I have heared is that, "The ticket is only recored once it is paid off in full." Supposedly, if you pay the ticket a little bit at a time and take a really long time to pay it off, you can delay the convition from being recorded. Possibly long enough for previous tickets to fall off of your record.
Like I said this is just what I have heared.:idunno:

True dat.

I avoided paying a cite from Cali for 3-1/2 years. By the time I paid it the fine had doubled but being the conviction was over 37 months it never went on my record.

Pay attention if you try that since if your license is up for renewal there will be a hold on it so you won't be able to renew.

Exhaust...Most standard, everday, aftermarket exhausts say "off-road use only" I imagine to get around EPA standards. Do police care about the exhaust itself, how much noise it makes, both, or neither?

DFinch

A LOT of cops ride Harley's with aftermarket pipes, so in general you won't have an issue.

If you're being obnoxiously loud, the noise does give them a legal reason to pull you over and chat with you.

There are areas of the country (like Denver) that have recently started cracking down on loud pipes. I know that NE 23rd in Portland generates a ton of calls complaining of loud motorcycles hanging out at the Starbucks, but so far hasn't resulted in any enforcement that I've heard of.

I'm still trying to decide what to do with my DX. I just got my race tuner, so the first step might be to drill out the baffles of the stock pipes (all 20lbs of them) and see how that sounds. 2-in-1 pipes give the best performance with the V-Rods, but the two most popular pipes (Reinhart and CFR) are very loud. CFR is suppost to release a baffled version any day now. I'm looking at those as option 2. I want good sound, but I want to be able to get out of my neighborhood in the early morning without pissing off the neighbors. It took 3 sets of pipes to achieve that with my Road King.

here was the response, to save him some time (I hope its ok that I reprint this):

"No worries Kalob I have no problem when people ask me questions, thats what I'm here for. In your case you could recieve a ticket which would cost around 242 dollars and also run the risk of getting your bike towed. The tow would cost another 2-3 hundred I'm guessing. Could lead to you becoming suspended down the road. Lot of the time I give the person till the court date to get valid then I'll drop the ticket. It will really depend on the officer that stops you as to if he will write ya. I'd say more would than wouldn't. Try taking that Team Oregon class, when you pass you go straight to DMV with certificate and they issue your license to ya. Hope that helps"

(ps-I have been registered for the TeamOregon class for almost two months now...long waiting list...July6,7,8 for me in Bend. Also, I was pming you originally about this because I was making a trip to Eugene and my car **** out on me...I, however, had a wonderful ride on my bike, hypothetically, and am constantly gaining confidence and skill on it! Hey, quick question. I've got a custom painted Shoei helmet, and although DOT approved, it no longer has the sticker on the back. Is that illegal? Or would I just be able to show the cop the inside of the helmet so he could see what it was?

Thanks! :)

DFinch

Technically, illegal.

1. Hard outer shell
2. Soft inner lining
3. Chinstrap retention device
4. DOT sticker (whether it is actually DOT or not, doesn't matter)

The court ruling on this included a complaint by a prosecutor that (paraphrased) "under that standard, you could put a napkin in a tuna can, strap it to your head with a shoelace, and put a label on the back with the letters 'DOT' on it, and it would be legal." The judged ruled that if the legislature intended differently, they wouldn't have changed the language the way that they did.

Wow! That is very strange. Technically though, it never says WHERE the sticker needs to be, could even be inside the helmet.

Quote from Legislative blah blah blah...
801.366 "Motorcycle helmet." "Motorcycle helmet" means a protective covering for the head consisting of a hard outer shell, padding adjacent to and inside the outer shell and a chin-strap type retention system with a sticker indicating that the motorcycle (http://whiz.to/%7Epapera/ORS/801.html#motorcycle) helmet meets standards established by the United States Department of Transportation. [1995 c.492 §2]

DFinch
06-21-2007, 03:10 PM
You are correct, but not having the sticker visible would give an officer PC to pull you over to check for one.

If you read the ruling, the judge ducked the issue of how to deal with a helmet that has had the sticker "fall off" or a helmet that had a clearly home-made sticker and referred that back to the state. It is my opinion that a state court would rule that not having a sticker on the outer rear shell, which if not an industry standard is clearly the norm, would give an officer the right to do a traffic stop to determine whether the helmet had a sticker at all.

The whole issue is a perfect example of lawmakers who aren't familiar with the issues trying to write law to solve specific problems. The law was originally changed because of a court ruling that said that requiring helmets that meet DOT standards is unenforceable because it is impossible for an officer in the field to determine to a legal degree if a helmet met the standard, so the helmet law was rewritten to it's present form. They decided that the only testable evidence of the standard in the field was the presence of the sticker, even though having the sticker doesn't prove the helmet does or doesn't meet the standard.

They should have either:

1. Left the sticker out if they wanted some form of required helmet, and let people wear what they want, or

2. Do away with the requirement completely

In the real world, if a cop wants to stop you he'll find a reason. Not having a sticker is one reason but there is a 3" book that has thousands of other reasons. If you are stopped, and have anything remotely resembling a real helmet, the lack of a sticker probably won't matter (in Oregon, can't speak for other states). Washington is in a similar boat after their "a helmet is a helmet" law that did essentially the same thing there that our change did here. I haven't checked to confirm that WA requires a sticker, but I don't think they do anymore. Check Google.

Mep, Question for you? So i'm waiting for my title transfer to go threw but in the mean time i am forced to have a trip permit. DMV said stuff it in a cubby and present on demand. A couple days ago an OSP cruiser pulled me over and wanted to see it.. I guess he was jelous that I was riding in the great weather and he had to wear the awesom mount me hat. LOL He said I had to have it visible.. I spoke with one of the captains on my fire dept "who happens to be a cop " and he said having it stashed is acceptable. Whats the right answer?
Thanks

The OSP Trooper was wrong:

http://arcweb.sos.state.or.us/rules/OARS_700/OAR_735/735_034.html

Display of Trip Permits
(1) Except as otherwise provided in this rule, trip permits for self-propelled vehicles shall be placed on the driver's side of the vehicle in the lower corner of the rear window.

(2) Trip permits may be placed in areas other than as provided in section (1) of this rule in situations where placement in the rear window is not possible or is impractical, including but not limited to situations where:

(c) The vehicle is a motorcycle, snowmobile, or Class 1 all-terrain vehicle;

(3) When a trip permit is not required to be placed in the rear window as provided in section (2) of this rule, it shall be placed in the lower right-hand corner of the rear, side window on the driver's side of the vehicle if the vehicle is equipped with one. If the vehicle does not have a rear side window on the driver's side of the vehicle, the permit shall be placed as follows:

(a) In the rear window of a camper, canopy or similar equipment when the permit is issued to the pickup carrying such equipment;
(b) On the dashboard on the driver's side of the vehicle visible through the windshield; or

*
(c) In the vehicle in a manner readily accessible for inspection upon request, when the permit is issued by teletype or transceiver, or where placement in any of the other allowed locations is not possible or practical.

If they can prove it was you. :idunno: I believe they have something like 90 days to issue the citation.

In the scenario you describe, you would go to jail for felony elude. A uniformed officer waving you over is giving a visible signal that meets legal standards, and if he can establish that you saw it and fled, you have committed the crime of "felony attempt to elude" just as if you had taken off when he lit overheads.

I just got a felony indictment on a guy who took off in a Mustang when I was on foot at the June "Last Thursday" event in NE because he took off when I yelled at him to stop.

If you change your scenario so that you're just talking about "can an officer wait 6 months to issue a citation", the answer is yes.

An officer can:

1. Witness a violation off-duty, wait until on-duty, find the driver, and issue a citation (within 6 months).

2. Witness a violation but too busy to deal with it. Locate driver later, issue citation (within 6 months).

3. Pull car over, give warning, see same car later doing something that makes you wish you wrote original citation, issue original citation (within 6 months).

Jackin MEP's thread.

Welcome to MATT (Multi Agency Traffic Teams). It is a new program Oregon started last year where they do increased enforcement, especially during times when they expect a lot of traffic. Supposedly by doing multi-agency saturations, the expectation is that people will know there are a lot more cops than just the normal 3 or 4 and will behave better during these times of increased motoring.

Fun if you are working! Not so fun if you are "trying to have fun"! :smilewink:

Is it legal for cops to approach intersections, flip their lights on and then just blow through, flipping them off on the other side? Yes it is legal, they are supposed to clear the intersection first and drive with due caution but its a legal move.

I have watched them do that then park less than a block away and sit there for 20 min or so till they got boared of sitting then did it again and left.

I also have a ?. Lets say you are riding along and someone puls in to your lane and you dont see them till the last second is it ok to put your foot against there door and save your self from getting crushed between the bike and car or maby from going down? If you do save your sellf do you pull over and treat it as an accident or just keep riding and hope the person dosn't car that you put a boot mark in there door?

I understand that, but as BMW guy pointed out, when I see them pull into convenience store or fast food parking lots 100 yards down the road, it makes me wonder. A few bad apples who take advantage of their position can leave a bad taste...

....anyone have an opinion on this:
http://www.copswritingcops.com/dotm/oct2006/index.html
I just finished reading through a good 20 or so of these postings, and I have to admit to be a little ambivilant.... on one hand these officers who are posting up seen to be genuinly concerned about the brotherhood of police officers, and they are concerned that proper respect for the office and brotherhood isn't really being had anymore... Also, If they were really just cruising ya know, 10-12 or so over, and nothing else, I think that any officer's discretion should lead them to let the LEO off, maybe "take it easy w the speed" at the most....
The other part of me is a little surprised at many of the postings that include (to one degree or the other), ".....I have been pulled over XXX times by an LEO and NEVER given a ticket. HOW DARE XXXXX. I nominate him for the DICK of the month..."
I'm not one to offer advice on following traffic laws; I've had my share of stupid offenses, and I have actually been very impressed with Portland's finest. I have much more respect for them since my encounters, since they have handled themselves with honor and courtesy.
Nonetheless one has got to wonder, how many times can an LEO be pulled over and given professional courtesy before A. He/she feels entitled to it, no matter the circumstances, B. They ask themselves "Wait, why AM I being pulled over so much???", and/or C. They're driving is subsequently affected due to a belief that there will be no consequence for their driving...
Hope this makes sense to some, and that I don't sound too hypocritical. After all, I'd kinda like professional courtesy if I were to be a LEO.

Drakhen
10-16-2007, 07:10 PM
I have little problem with a little professional courtesy, but I the "dick of the month" posts ticked me off. Especially when it was the officer's wife getting the ticket and the officer expecting to get them out of it. I noticed that none of the officers whose posts I read mentioned what the offense was. This lends me to believe that their fellow officers might not have much sympathy for them if they knew.

As far as the tickets go I am not going to even say anything since I will get flammed. But I also think no one should have a get out of free jail card either.

Thats why they call it discrection sp? so the cop can make the call according to the situation.
