So I exit the freeway next to my house. I pull up to a light and there is another sportbike next to me. We both see the State trooper in the opposing lane, so we take off as slow as turtles.
The trooper turns around and stops both of us. Luckily, I have been studying Oregon law for 5 years now, and I know a few things.
Here is how the conversaton went:
Cop: I am blah, blah,blah with the Oregon, blah,blah,blah.. You were stopped for exhibition of speed.
Me: Exhibition of speed? There has to be intent in that law, and I had no intent. Just because I'm next to another bike does not mean we were engaged in a speed contest. Do you even know the definition of that law?
Cop: No, but I can look it up.
Me: You don't even know the definition of ORS 811.125? I hope this conversation is being recored because my attorneys will want to subpoena the recording through discovery.
The cop was in training, and went back to the car to get the other veteran cop who was training him.
New cop: Did you not understand why we pulled you over!? Is this bike stock!? (kinda yelling at me..)
Me: I am not obligated to answer any of your questions without an attorney present. Your trainee couldn't even give me the definition of ORS 811.125. Can you? I know the law very well officer and....(he cuts me off)
New cop: You need to shut your mouth otherwise you will be charged with exhibition of speed! (now he is alittle more upset).
Me: Officer, you are saying that if I don't suspend my section 8 constitutional rights (freedom of speech), you are going to charge with me with a crime? You just violated ORS 163.275 (Corecion) which is class C felony. You are supposed to be protecting the rights of the citizens and upholding the constitution, not breaking felony laws during traffic stops. Who was driving that cruiser?
New cop: (stunned look on his face now) I don't have to answer any of your questions either Sir.
He goes back to the car and the trainee comes back out with my DL.
The trainee said, "sorry to have disturbed you" - and let me go.
