Actually MEP, I would love to read your opinion on this....even as basic as it may be (even a 'shut the hell up and deal with it'). In sb.ws posts I've found your comments to be pretty unbias, so..I respect your opinion.

Here's my deal....

My morning, sweet holy hell…. I usually take it in stride, not ever in a hurry to get to work, I don’t fight traffic or get bent out of shape about it. I just grab my morning drink and turn the radio up loud and deal with it.
This morning…….damn. I was merging onto I-5 next to a black suburban, had my blinker on. As I began merging into the lane, the school bus that was behind the suburban kept speeding up. So, I backed off a bit from pulling into the lane and was still coasting forward (under 10mph). When there was a bit more space I started to move into the lane again, which the bus driver started speeding up again, subsequently hitting my left rear bumper, not the quarter panel, the bumper itself.
****!!!! So, we pulled over and I called WA State Patrol – they showed up and were dinking around with the bus driver (it’s pouring rain, so I hadn’t gotten out of the jeep yet). After a few too many minutes, I put on my rain jacket and got out to see what was up. The WSP asked me what happened and I explained. Without hesitating he said “I’m not going to file an accident report, because if I did I would have to cite you.” What the ****?!!??!!??!!! I calmly told him that I’m not challenging his decision and if he could explain his reasoning. He said that since I was merging onto I-5 that I should give the right-of-way to traffic on the interstate. I commented that the bus driver accelerated into me. His comment was, “it’s the interstate, you’re suppose to accelerate” ….??????? What! - I responded with, it’s rush hour, all traffic in all lanes was going under 10mph – there is no where to accelerate to, that I had merged appropriately into the lane and she hit my bumper, not the side of the jeep, the bumper. That was his decision and he wrote up “information” but did not file a report at all.
Sweet holy hell - - - - so pissed off this morning. The jeep is fine, there weren’t any kids in the school bus, so that is fine - - - -just me and “1adam12” just don’t seem to be getting along this year.
In 20 years of driving I have never (yes NEVER) had an accident in a car/jeep. I’m a very patient driver. In all my years I’ve had two traffic infractions, for speeding one for 8over and the other for 12over.
Am I going nuts here…..she hit me, on the bumper, suggesting that she hit me from behind…..and I’m at fault (if traffic dood were to write it up)

After my dealings with clark county’s finest and now the WAstate chargers it would take a lot of convincing to have me vote ‘for’ any measure that supports employment or job retention for those responsible for ‘traffic safety and enforcement’. I believe my direction and support would be along the lines of mandating enforcement, mandating fines and penalties, taking the ‘discretion’ away from traffic enforcement, requiring tickets and penalties and fines to be levied. I feel a bit justified in saying this because I am seldom ever pulled over, and this would serve a couple purposes; 1) it would require traffic enforcement to …..enforce without discretion, profiling, or prejudice. And 2) it would (hopefully) deter drivers from infractions (that should be misdemeanors) if they know that ‘if pulled over’ that the leo “will” give you a ticket.
Use new money to fund enforcement to support suppressing violent crimes, drugs, crimes against children,……whatever. Just don’t throw money at traffic enforcement unless “we” (the royal we) can convince the state legislature to modify many of the infractions to become misdemeanors – that would support and assist (IMO) traffic enforcement, greatly….imoimoimoimoimo.

Rant over….. you can pick you head up now MEP, the barrage is over..

Just an observation but was there damage to your bumper? If not, i wouldnt have even worried. You both were right but I think the cop didnt realize you had already merged into the lane, in which case you would have been correct.

Yep, there was damage.
I commented to the wsp'man that after the convergence of lanes she struck me in the left rear "bumper", not the side, and not the quarter panel. There was a CCdeputy that was looking over the bumper of the bus but didn't comment.
I was told that I should have yielded the right-of-way, which I would agree with if I wasn't already in front of the bus, already in the lane.
So, regardless of my rant (just an opportunity for me to bitch about it) what is done is done. My jeep is strongly loved (plenty of nicks/dent/dings from general use over 12yrs) - so a broken bumper isn't sending me over the edge. I'm not pursuing this any further, I'm not out to get anything from this, the driver, the bus company, the school district.....
I was just flabbergasted that the wsp'man was soooo quick to advise that I was at fault for (failure to yield) getting rear-ended.

what just plays with my mind most is that the cager that caused my motorcycle accident earlier this year ONLY was given a failure to yield..... that seems to be my 'thang' ......I might consider a screenname or title change to 'failure to yield'. hehehehe.

If you were merging to the left onto the slow lane of the freeway and were struck in the left rear bumper then the trooper was correct as bad as that sounds. Its the responsibility of the driver merging onto the freeway to make sure its safe to do so. That being said I think it should be the other way around and the people on the freeway should yeild to people entering but hey I didn't write it. If your onramp had you getting onto the freeway to the right then she/bus driver should have been at fault. Sorry about the accident and glad not much damage and nobody got hurt.

Rant away buddy. Yours are done in a professional manner and not viewed as a personal attack by the way.... :thumbup:

Yep, I'm sooooo splitting hairs here, but my perspective was the merge was complete, there was no division of lanes. Thus, I feel that I was more rear-ended than failed to yield......

I'm almost over this, more because I have a couple JaSS' at work that I'm having to deal with. I swear to office-space that I'm getting ready to throw my pocket protector at someone any minute now.
