View Full Version : Any way to fight photo radar ticket?

Found out today I got a photo radar ticket last week in the work truck on SE Powell. I remember seeing the van and checking my speed as I went by and thought I was in the clear. I guess I was wrong. To make things worse it was in a school zone so I got popped for 36 in a 20 which is a $145 fine.
Is there any way that another car could have tripped the sensor? I remember a car coming up on me at a decent pace and changing lanes to pass me on my left as I came up to the radar van.
If I can't fight the ticket is there any way to get the ticket cleared off my record by going to some sort of driving school? I've had a clean record for 6 or 7 yers and I'd really like to keep i that way for insurance reasons and the fact that I have a CDL for my job.

seriously though...I have no idea how to fight that there ticket.
I got a photo redlight ticket about 6 years ago on W. Burnside near Civic
Stadium. The line just to even plead guilty/not guilty at the courthouse was 2 hours long! Suggestion: show up friggin early on your plead date.
I hate those cameras!

I got to thinking about that as well, Skipbo. Go and plead to the DA, or Judge or whoever is up there listening to you. They usually knock a fare share off the ticket. Donno if they will drop it tho. You can talk to them and see.

Are there any kind of safety classes or some BS like that where they'll clear the ticket from your record if you attend? I've heard they'll do some kind of diversion for drunk driving so I'd think there'd be something like that for speeding tickets. I just want to keep my record clean, I don't care about the fine.

You don't even have to go before a judge to get it dropped, just go to the counter and ask for a diversion. They'll charge an admin processing fee (usually $100 or so), but won't file the ticket. The judge signs off on it and as long as you don't get another ticket (and a couple other minor stipulations) for a year, it goes off your record and you don't have to report it in the meantime.

Sweet! Thanks for thre info, that's just what I was looking for. :rad: I really hate parting with my money but I hate parting with my money even more when it involves an insurance company and jacked up rates.

Its called DEFERRMENT. You must request it from the court (judge). You are basically pleading guilty, pay the fine, and then agree to not get another citation for a given period... usually 6-12 months. After that time you send the court a copy of your driving record, and if you have no new citations, they discard the ticket and it doesn't go on your driving record.
Usually they will do this only if you already have a decent record, or are a professional driver (CDL etc). You are only allowed a deferrment once every "so many years" (not sure of the exact limitations.)
Wiife and I both got matching speeding tickets last May in Mitchell, OR on my way to Hells Canyon Rally. We requested deferrment and both got it, but had to pay the reduced fine to the court. We also had to send the court a copy of our driving records after 6 months. The tickets never went on our records.

Well, sounds like I meet the requirements. My record has been clean for 6 or 7 years and have a CDL. I guess I'll have to go downtown to the courthouse and go from there. Thanks for the help guys.
